Downtown Fernandina Beach, inside the local historic district, is built around Victorian era homes on small in-town lots, most platted well before pools were common and with little room to spare once setbacks and the historic footprint are accounted for. Who permits a pool in Fernandina Beach?
Inside Fernandina Beach city limits, the City of Fernandina Beach Building Department issues the pool permit through its online portal. In the Downtown and Old Town local historic districts, the Historic District Council reviews site changes, including pools, decks, and lighting, under Chapter 8 of the land development code, and a Certificate of Appropriateness has to be issued before the building permit is released.
Outside city limits, on the rest of Amelia Island and across Yulee, the Nassau County Building Department has jurisdiction, with its own checklist that requires verifying whether the lot sits in a flood hazard area before the pool permit is issued. Inside Amelia Island Plantation, a private Architectural Review Board reviews pools, decks, patios, and lighting under community design standards before the county will accept the application.
Because three separate review paths can apply on this one island, from HDC downtown to county to a private ARB, confirming the correct one for a specific parcel is our first step.
